Что такое «инквест», и что он способен изменить в этом деле?
Для начала – посмотрим, как это понятие объясняют на сайте «Фонд справедливости имени Литвиненко» (официально возглавляемого Мариной Литвиненко и Алексом Гольдфарбом – а субсидируемого, естественно, Березовским)[85]:

Судебное дознание по факту смерти – inquest – особая норма британского правосудия, позволяющая рассматривать обстоятельства гибели человека вне рамок уголовного дела, в отсутствии обвинения и защиты. Такой суд не может выносить приговор, но вправе назвать виновных.
Инквест проводит судья‑дознаватель (коронер), который заслушивает аргументы заинтересованных сторон, таких, как семья погибшего, представители властей и лица и организации, в отношении которых есть подозрения.
Наиболее известные случаи инквеста последних лет – расследование обстоятельств гибели принцессы Дианы и терактов у июля 2005 года в Лондонском метро.

То есть, если отвлечься от юридической казуистики, «инквест» – это просто дознание по факту смерти, проводимое «коронером», или судьей‑дознавателем, в присутствии адвокатов обеих сторон. Это именно то, что обычно проводится властями любой страны мира, если кто‑то из ее граждан (или подданных) умирает при непонятных обстоятельствах.
С этим все предельно ясно. Правда, невольно возникает несколько других серьезных вопросов.
Во‑первых, совершенно непонятно, почему дознание по поводу смерти Литвиненко следует проводить через пять лет после его смерти? (То, что из утверждения «дознание будет проведено» естественно вытекает «…поскольку до этого его никто так и не проводил» – мы считаем самоочевидным.) То есть, конечно, трудно спорить: через пять лет – это все‑таки намного лучше, чем через двадцать (или, тем более, через сто). Однако, было б еще лучше, если б дознание было проведено немедленно после смерти. Подозреваем, что тогда и шансы на успешное расследование были бы намного выше.
Во‑вторых: раньше нам ведь, вроде, популярно объясняли, что успешному расследованию мешает лишь отсутствие обвиняемого? Однако, единственный обвиняемый (Андрей Луговой) как не собирался приезжать в Лондон, так и не собирается. Но проведению расследования это почему‑то уже нисколько не препятствует. Более того: оказывается, Луговой будет участвовать в предстоящем расследовании в качестве свидетеля по делу. Он будет даже давать показания – но по видеосвязи из Москвы! Может быть, он отказывался это делать раньше? Нет, неправда – наоборот, сам это многократно предлагал! Так что же все прошедшие годы так сильно мешало британскому следствию заслушать его показания?
В связи с этим уже возникает и третий вопрос. А надо ли считать, что проведение «инквеста» по «делу Литвиненко» полностью дезавуирует все обвинения в адрес Лугового, выдвинутые британскими властями ранее? Ведь нельзя же всерьез обвинять человека в убийстве – невзирая на то, что следствие до сих пор не смогло установить, было убийство, или его не было? В вышеприведенной цитате (взятой, заметим, не откуда‑нибудь – а непосредственно с сайта друзей Литвиненко) сказано открытым текстом, что главной задачей «инквеста» является установление причины смерти покойного. И, пока инквест не завершен – официально неизвестно, был ли Литвиненко убит преднамеренно, или убит случайно, или совершил самоубийство, или просто стал жертвой несчастного случая. Потому что именно это инквест должен установить. Что ж, давно пора. Вот только что теперь делать с предыдущими обвинениями в адрес Лугового? Можно ли их теперь рассматривать как‑либо иначе, кроме как преднамеренную клевету?
Наконец, четвертый вопрос (и самый важный). Если все‑таки проведению инквеста кто‑то препятствовал – то кто именно, как, и почему?
